ITC Litigation

Imports that infringe upon domestic intellectual property rights can be difficult to stop via litigation – especially if there are multiple suppliers or the goods are sold under different names.  In such instances, International Trade Commission (ITC) proceedings may be used to bar infringing products from entering the United States.  Conduct associated with a product that constitutes unfair competition – such as misappropriation of trade secrets, passing off, false advertising and violations of antitrust laws – also may be precluded by an exclusion order.

XDL Group professionals are equipped to work with United States Customs and foreign customs services to interdict and seize products that infringe United States intellectual property rights.  In some countries, such as China, an XDL Group task force will work with foreign colleagues to interdict goods before they leave the country.
